Welcome to NB Cookie Consent Pro. By purchasing, installing, or using this plugin, you agree to these terms.

1. Product Description

NB Cookie Consent Pro is a WordPress plugin that provides:

• Cookie consent banner display with multiple styles
• Cookie category management (Essential, Analytics, Marketing)
• Google Consent Mode v2 integration
• JavaScript function blocking for tracking scripts
• Cookie scanner with known cookies database
• Consent logging for record-keeping
• Cookie policy page generator

The plugin is a technical tool that assists with cookie consent management. It is NOT a legal service and does NOT provide legal advice.

2. License & Intellectual Property

Split License Model: The PHP code of this plugin is licensed under the GNU General Public License (GPL) v2 or later, as required by WordPress. This GPL license applies ONLY to the PHP code.

Proprietary Assets: All other assets are the exclusive intellectual property of Netbuy and are NOT licensed under GPL, including:

• CSS stylesheets and design code
• JavaScript files and functionality
• Images, icons, and graphics
• The "NB Cookie Consent" brand name and logo
• Visual design elements and user interface

Restrictions: You may not copy, extract, redistribute, or reuse any proprietary assets without express written permission from Netbuy.

License Key Terms:

• One License = One Domain: Each license key is valid for use on one (1) website domain only
• Updates: Your license includes one year of updates from the date of activation
• Support: Email support is included for the license period
• Renewal: After one year, you may renew your license to continue receiving updates. The plugin will continue to function without renewal, but you will not receive new features or security updates
• No Sharing: Your license key is for your personal or business use only and may not be shared, resold, or transferred to others

3. Your Responsibilities

• Legal Compliance: Ensuring your website complies with GDPR, CCPA, ePrivacy Directive, LGPD, and any other applicable privacy laws in your jurisdiction
• Cookie Audit: Identifying and categorizing ALL cookies used on your website correctly
• Privacy Policy: Maintaining an accurate and legally compliant privacy policy
• Consent Text: Ensuring your consent banner text is accurate, clear, and meets legal requirements
• Third-Party Scripts: Managing and properly blocking third-party tracking scripts until consent is given
• Regular Updates: Keeping the plugin and your cookie inventory up to date
• Legal Consultation: Consulting with qualified legal professionals for compliance advice

4. Cookie Database Disclaimer

The plugin includes a database of 255+ known cookies for identification purposes. However:

• This database is provided for convenience only and may not be complete or accurate
• Cookie purposes and categories may change without notice by third-party services
• You must verify that all cookies are correctly identified and categorized
• New cookies may be added to your site by theme updates, plugin updates, or third-party services
• We do not guarantee the accuracy of cookie descriptions or categorizations

5. Limitation of Liability

NB Cookie Consent Pro is provided "AS IS" without any warranties, express or implied.

Netbuy and its owners, employees, and partners are NOT liable for:

• Any fines, penalties, or legal actions resulting from non-compliance with privacy laws
• Data protection authority investigations or enforcement actions
• Loss of business, revenue, or reputation
• Indirect, incidental, special, or consequential damages
• Technical issues, conflicts with other plugins, or website downtime
• Inaccuracies in the cookie database or scanner results
• Third-party services that bypass consent mechanisms
• Browser extensions or settings that affect plugin functionality

Maximum Liability: In no event shall our total liability exceed the amount you paid for the plugin license.

6. Indemnification

You agree to indemnify, defend, and hold harmless Netbuy and its owners, employees, and partners from any claims, damages, losses, fines, penalties, or expenses (including legal fees) arising from:

• Your use or misuse of the plugin
• Your failure to comply with applicable privacy laws
• Your failure to properly configure the plugin
• Any third-party claims related to cookie consent on your website
• Your violation of these terms

7. No Legal Advice

We are software developers, not lawyers.

• Nothing in this plugin, its documentation, or communications from Netbuy constitutes legal advice
• Feature descriptions mentioning "GDPR compliance" or similar terms refer to technical capabilities only
• You must consult qualified legal professionals for compliance guidance
• Privacy laws vary by jurisdiction and change frequently - stay informed about laws that apply to you

8. Refund Policy

Try Before You Buy: Since a Free version of the plugin is available for testing, and all Pro features are fully documented, we generally do not offer refunds for "change of mind" or mistakenly purchasing the wrong product.

14-Day Money-Back Guarantee (Conditional): We will grant a full refund within 14 days of purchase ONLY IF all of the following conditions are met:

• The plugin is technically defective or causes a critical error on your site; AND
• You contacted our support team and allowed us to attempt to resolve the issue; AND
• We were unable to fix the issue within a reasonable time frame.

Refunds are NOT granted if:

• You simply changed your mind
• You decided you don't need the plugin anymore
• The issue is caused by a conflict with a third-party theme or plugin that you are unwilling to troubleshoot
• You purchased the plugin but never downloaded or activated it (after 14 days)
• You failed to contact support before requesting a refund
• The plugin works as documented but doesn't meet your specific expectations

Upon approved refund, your license will be deactivated and you must uninstall the plugin from your website.

9. Support & Updates

• Support is provided via email only
• We aim to respond within 2 business days
• Support covers plugin functionality and basic configuration
• Support does NOT include legal advice, custom development, or third-party plugin conflicts
• Updates are provided at our discretion and may include new features, bug fixes, and security patches

10. Termination

• You may stop using the plugin at any time by deactivating and uninstalling it
• We may revoke your license if you violate these terms
• We may discontinue the plugin with reasonable notice (minimum 6 months for existing customers)

11. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the State of Israel.

Any dispute arising from or relating to these terms or the use of NB Cookie Consent Pro shall be subject to the exclusive jurisdiction of the competent courts in Haifa, Israel.

By using this plugin, you consent to this jurisdiction regardless of your location.

12. Class Action Waiver

WHERE PERMITTED UNDER APPLICABLE LAW: You and Netbuy agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative action.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including:

• Natural disasters, war, terrorism, or government actions
• Cyber-attacks or security breaches despite reasonable security measures
• Failure of third-party services (hosting, WordPress.org, payment processors)
• Power outages or internet infrastructure failures
• Pandemics or public health emergencies

14. Changes to Terms

We may update these terms from time to time. Significant changes will be announced via email to license holders. Continued use of the plugin after changes constitutes acceptance of updated terms.

15. Governing Language

This Agreement may be translated into other languages for convenience. If there is a conflict between the English version and any translated version, the English version shall control.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Netbuy regarding NB Cookie Consent Pro.

nbplugins is a brand of Netbuy, a business registered in Israel. References to "Netbuy", "we", "us", or "our" in these terms refer to Netbuy and its nbplugins brand.
